MnDOT FLSA Update

29 September 2026

MnDOT leadership has recently contacted some supervisors, telling them that they have made “errors” in time approvals, potentially setting off another round of “overpayments” affecting our members.  While each situation must be evaluated independently to determine whether it rises to the level of a grievance, MGEC has responded to MnDOT leadership in no uncertain terms that one party cannot simply change the contract by changing the definitions of contract terms. In the original set of repayment orders that stem from early 2025 that resulted from the presence of a holiday in a pay period with approved overtime, MGEC is pursuing mediation to settle the issue.  As mentioned earlier in this space, MMB went around MGEC to pursue collections in administrative court.  MMB summoned people to court over a contract interpretation issue.  MGEC paid to represent those employees and got an administrative “stay” halting any collection until the issue could be resolved.
